BARÇA GAMES is an online gaming platform licensed by FUTBOL CLUB BARCELONA (hereinafter, FC BARCELONA) with the goal of encompassing a community of online players, fans, and supporters of FC Barcelona who participate in it.

BARÇA GAMES is governed by the regulations exclusively applicable in Spain and is subject to them. Without prejudice to the fact that, in the event of any discrepancy and as long as the user acts as a consumer from a Member State of the EU, the user may refer to the courts of his/her place of residence.

Under these terms of use (hereinafter, the Terms of Use), every user of Barça Games will have their Barça Account and be registered in the Barça Environment, regardless of their prior registration method (Apple ID, Google Account, Facebook, email, etc.).

Access to BARÇA GAMES is free, and its use is governed by the terms of use in effect at the time of access, which we ask you to read carefully. If the user does not agree with these Terms of Use, he/she must refrain from using this app and may contact FC BARCELONA to resolve any questions related to them.

The content offered will consist of (descriptive and not restricted to) a wide catalog of free and/or paid online games and tournaments that users can use and/or register for through this digital platform. In this case, for the use and/or purchase of online games offered by third parties on the BARÇA GAMES platform, the user must accept and comply with the terms of use and/or purchase of the chosen game provider.

Intellectual Property

All rights to the content, texts, images, trademarks, and source codes that make up the BARÇA GAMES platform are owned by FC BARCELONA or third parties from whom the necessary authorizations for exploitation have been acquired and are protected by Intellectual and Industrial Property rights.

The user of the BARÇA GAMES platform does not acquire any intellectual or industrial property rights over the content, texts, images, trademarks, and source codes that make it up, and only has the right to personal and non-commercial use of it. The user may not copy, modify, transform, publicly display, distribute, or transmit any of the materials obtained from the BARÇA GAMES platform.

BARÇA GAMES and FC BARCELONA are registered trademarks, and their reproduction, imitation, use, or insertion without the proper authorization of FC BARCELONA is prohibited.

Imitating our BARÇA GAMES platform, whether totally or partially, or establishing links to the BARÇA GAMES platform without prior authorization from FC BARCELONA is strictly prohibited.

Access and Use Conditions

Access to the BARÇA GAMES platform is free; it only requires prior registration to obtain a "Barça Account" that allows you to enjoy the platform and other services of FC Barcelona.

However, participation and use of some of the games and tournaments offered may require prior registration in them, with BARÇA GAMES being unrelated both in the registration process and the specific conditions of each game. These services will be duly identified.

The submission of personal data implies the express acceptance by the user of our privacy policy.

Specifically, during the use of the "Barça Platform," the User undertakes to:

Access it in accordance with good faith, public order regulations, and these Terms of Use. Access to the BARÇA GAMES platform is carried out under the user's own and exclusive responsibility, who will be liable in any case for damages that may be caused to third parties or to FC BARCELONA.
Not use or obtain the services, products, and content offered on the platform by means other than those stipulated in these Terms of Use and, where applicable, in the specific conditions that regulate the acquisition of certain products.
Not to perform any actions on our platform that may cause an excessive overload on our computer systems, such as the introduction of viruses, or the installation of robots or software that disrupts the normal operation of the BARÇA GAMES platform, or ultimately, may cause damage to our computer systems.
Not to reproduce in any way, not even through a hyperlink, the BARÇA GAMES platform or any of its contents, unless expressly authorized in writing by FC BARCELONA personnel with sufficient power for such purposes.
Not to delete, bypass, or manipulate the copyright and other identifying data of the rights holders incorporated into the content, as well as the technical protection devices, or any information mechanisms contained in the content.
Not to alter, reprogram, modify, adapt, or translate the source code of the application. Any partial or total reproduction of the source code of the BARÇA GAMES platform on any medium and for any reason will be considered an unauthorized copy.
Not to introduce, store, or disseminate, on the BARÇA GAMES platform or from it, any information or material that may be defamatory, libelous, obscene, threatening, xenophobic, inciting violence, promoting discrimination based on race, sex, ideology, religion, or in any way, infringing upon morality, public order, fundamental rights, public liberties, honor, privacy, or the image of third parties, and, in general, current regulations.
Not to introduce, store, or disseminate, on the BARÇA GAMES platform or from it, any program, data, virus, code, or any other electronic or physical device that is capable of causing damage to the Platform, to any of FC BARCELONA's services, equipment, systems, or networks, to any other user, to sponsors, collaborators, suppliers, etc., of FC BARCELONA, or, in general, to any third party.
Not to carry out advertising activities or commercial exploitation through the BARÇA GAMES platform, and not to use the content and information to send advertising, messages for any other commercial purpose, or to collect or store personal data of third parties.
Not to use false identities or impersonate others in the use of the BARÇA GAMES platform or any of its services, including the use of passwords or access keys of third parties or in any other way.
Not to destroy, alter, use for its own purposes, disable, or damage the data, information, programs, or electronic documents of FC BARCELONA, its sponsors, collaborators, suppliers, or third parties.
Not to introduce, store, or disseminate through the BARÇA GAMES platform any content that infringes on the intellectual property, industrial rights, or trade secrets of third parties and, in general, no content for which the user does not have the right to make available to third parties in accordance with the law.

It is prohibited to conduct any type of advertising or commercial information directly or to send mass emails (spamming) without proper authorization. The user agrees not to introduce programs, viruses, macros, applets, ActiveX controls, or any other logical device or character sequence that may cause or be susceptible to causing any type of alteration in the computer systems of FC Barcelona or third parties.

The platform provides users with a private chat, for which the following rules and conditions must be respected:

Accept that his/her username or nickname appears as the author of the published content.
Post only content that, in good faith, can be considered useful and appropriate.
Do not publish commercial or advertising content or content with a profit-making purpose.
Post only content that does not violate any law or infringe on the rights of third parties, especially those related to intellectual and industrial property, the right to privacy, honor, and image.
Use correct language and refrain from including offensive or vulgar words that may be considered distasteful by others.
Users assume exclusive responsibility for the content they post.
In the event of a user violating these terms of use, FC BARCELONA may impose sanctions, including the possibility of indefinite expulsion, depending on the severity of the breach.
Any user who detects infringing behavior by other users, especially regarding individuals' rights such as dignity, privacy, or freedom of expression, may notify FC BARCELONA via email at dpo@fcbarcelona.cat.

Privacy Policy.

Confidentiality and security are fundamental values of FC BARCELONA, and therefore, we are committed to guaranteeing the privacy of users at all times and not collecting unnecessary information. All personal data obtained within the BARÇA GAMES platform will be processed by FC Barcelona as the data controller.

The provision of personal data for this purpose requires a minimum age of 14 years and the express acceptance of our Privacy Policy.

The user agrees to promptly inform FC BARCELONA of any changes in personal data, especially those related to the bank account for the domiciliation of payments, if applicable.

The registered user with a Barça Account agrees to provide true, accurate, and complete information during the registration process and to keep it updated at all times. It is prohibited to supplant another person or entity or falsify one's own identity in any way.

The user acknowledges and accepts that we may take necessary measures to verify the accuracy of the information provided.

We may suspend or cancel your account and your ability to use the BARÇA GAMES platform or part thereof if you have attempted to supplant another person or entity or have attempted to falsify your identity in any other way, as well as in the event of any violation of these Terms of Use or any other terms applicable to the BARÇA GAMES platform.

Responsibilities.

By making the BARÇA GAMES platform available to the user, we aim to offer a quality service, using the utmost diligence in its provision, as well as in the technological means employed. However, FC BARCELONA does not guarantee that the availability of the service will be continuous and uninterrupted, due to circumstances arising from problems in the Internet network, breakdowns in computer devices, or other unforeseeable circumstances. Therefore, the User agrees to bear these circumstances within reasonable limits.

FC BARCELONA reserves the right to deactivate any user who has registered and/or subscribed if it is found that they have violated the Terms of Use of the platform. Likewise, it reserves the right to take legal action against those who violate these Terms of Use.

Fraud.

The user will be liable to FC BARCELONA for actual and proven damages, including reputational damages, resulting from the breach of their obligations under these Terms of Use or the violation of applicable regulations, when such actions facilitate, result in, or in any other way contribute to fraudulent acts against FC BARCELONA and/or any third party.

Therefore, the user shall refrain from carrying out any action (whether by action or omission) directly or indirectly that involves a use not contemplated in these Terms of Use.

FC BARCELONA may immediately suspend the service if it confirms any serious breach by the user of this obligation.

Jurisdiction and validity of the Terms of Use of the BARÇA GAMES platform and modifications

All matters related to the BARÇA GAMES platform are exclusively governed by Catalan, Spanish, and international legislation applicable.

In the event of any conflict or discrepancy in the interpretation or application of these legal terms, the courts or tribunals that will have jurisdiction over the matter shall be those established by the applicable legal regulations regarding competent jurisdiction, which, in the case of end consumers, will be determined by the place of fulfillment of the obligation or the user's domicile.

If the User's domicile is outside a Member State of the EU, both parties expressly waive any other jurisdiction that may correspond to them and submit to the Courts and Tribunals of Barcelona (Spain).

These Terms of Use have been modified as of June 4, 2024. We reserve the right to modify them at any time: please check the issuance date each time you connect to the BARÇA GAMES platform to ensure that no modifications affecting you have been made.
